These Terms of Service ("Terms") govern your use of the CostSegNow website and cost segregation analysis service located at costsegnow.vercel.app ("Service"), operated by CostSegNow ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. What CostSegNow Delivers

CostSegNow provides automated cost segregation analyses using IRS-recognized RCNLD (Replacement Cost New Less Depreciation) methodology, calibrated against real engineering studies. Reports include component-level detail tables, MACRS depreciation schedules, NPV analysis, and tax authority references.

Our analyses are built for rental and commercial property owners who want a professional-grade breakdown of accelerated depreciation opportunities โ€” delivered digitally, at a fraction of the cost of a traditional study. That said, CostSegNow reports are automated analyses, not formal engineering-based cost segregation studies. They are intended for tax planning purposes and do not constitute tax advice, legal advice, or accounting advice.

2. Work With Your Tax Professional

CostSegNow analyses are designed to give you and your CPA a clear, detailed starting point for tax planning. Our reports provide the component classifications, depreciation schedules, and supporting references your tax advisor needs to evaluate your cost segregation opportunity. We recommend consulting your CPA, tax advisor, or qualified tax professional before filing any tax return or taking any tax position based on a CostSegNow analysis, as tax outcomes depend on your individual circumstances.

3. Accuracy and Methodology

CostSegNow's engine uses RSMeans construction cost data and allocation profiles calibrated against real engineering cost segregation studies. Our estimates typically fall within 10โ€“15% of full engineering studies for residential properties. However, we do not guarantee any specific tax outcome, savings amount, or IRS acceptance of the classifications in our reports. Tax law is subject to change, and individual results will vary based on property characteristics, tax situation, and applicable regulations.

4. Your Property Information

You provide the property details that power your analysis โ€” including address, purchase price, building features, year built, and other characteristics. The more accurate and complete your inputs, the more reliable your results. CostSegNow generates your report based on the information you provide and does not independently audit or verify property details. You are responsible for ensuring accuracy of the data you enter.

5. Limitation of Liability

CostSegNow delivers data-driven analyses to support your tax planning decisions. Responsibility for tax positions taken based on our reports rests with you and your tax advisor. To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service shall not exceed the amount you paid for the specific report giving rise to the claim.

In no event shall CostSegNow be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, tax penalties, interest, or additional taxes assessed by the IRS or any state tax authority.

6. Pricing

A CostSegNow analysis is $199 per property โ€” a flat professional fee for a complete cost segregation report. This fee is not based on or contingent upon the results of the analysis or the tax savings identified in the report.

7. Digital Delivery and Refunds

Your report is generated and delivered as a downloadable PDF immediately after payment โ€” no waiting weeks for results. Due to the nature of instant digital delivery and immediate report generation, all sales are final and no refunds are available after report generation.

8. Corrections

We stand behind our reports. If you discover an error in the property information you provided, or if you need adjustments to your analysis, you may request up to 5 corrections after purchase at no additional charge.

9. Intellectual Property

CostSegNow's reports, engine, methodologies, software, and content are our intellectual property. Your report is licensed for your personal or professional use in connection with the specific property analyzed. You may not:

CostSegNow may update these Terms at any time. We will post the revised Terms on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws provisions.
